+Damp and mould is caused by excess moisture in the air combining with cold surfaces for that moisture to condense on. The three most common contributors are insufficient ventilation, inadequate heating, and cold spots in the building fabric. Resident behaviour plays a smaller part than is often assumed — fabric and heating play the larger role. A continuous monitoring device can distinguish between all three causes, which is something a single annual inspection cannot do.
What does Awaab’s Law require?
+Awaab’s Law, enacted through the Social Housing (Regulation) Act 2023, requires social housing landlords to investigate reports of damp and mould within 24 hours and to begin remediation within a defined timeframe (14 days for prescribed hazards). Crucially, landlords must also demonstrate that they took reasonable steps to prevent the hazard — which is where a continuous evidence record becomes essential. COSIE homes writes that record daily.
Is damp my landlord’s responsibility?
+Yes, in most cases. Housing providers are legally responsible for structural and fabric causes of damp — cold walls, poor insulation, inadequate heating systems, and insufficient ventilation. Under the HHSRS and Awaab’s Law, landlords have a duty to investigate and remedy these hazards promptly. Residents have a responsibility to ventilate and heat the home appropriately, but fabric-caused damp is clearly the landlord’s responsibility to resolve.
How does continuous monitoring change the evidence?
+A single annual inspection gives you a snapshot — one set of readings on one day. Continuous monitoring writes a near-continuous record, uploaded regularly. When a complaint arrives or an enforcement notice lands on your desk, the evidence record already covers the preceding months. Do sensors collect personal data? Can residents refuse?
+COSIE homes sensors collect environmental readings only — temperature and relative humidity. There are no cameras, no microphones, and no data that identifies individuals. Readings cannot be used to infer whether anyone is home. Because no personal data is collected, the GDPR considerations are straightforward. Most landlords include sensor installation as a standard term in the tenancy agreement for new lets.
